1. Scope

These Terms of Use apply to the use of the Keep2Cook platform.

The operator of Keep2Cook is:

Keep2Cook is a web-based platform for digitizing, editing, and managing recipes, planning groceries, and supporting users while cooking.

By registering for or using Keep2Cook, you accept these Terms of Use.

2. Minimum Age

Use of Keep2Cook is permitted only for persons who are at least 18 years old.

By registering, you confirm that you are at least 18 years old.

The age restriction also applies to all AI-powered features.

3. User Account

A user account is required to use Keep2Cook.

Registration requires a valid email address and a password.

You are responsible for keeping your credentials confidential.

You may not transfer your user account to other persons or allow others to use it.

4. Costs

Keep2Cook is offered free of charge during the current beta phase.

The free provision does not create any entitlement for Keep2Cook to remain free of charge permanently.

If paid features are introduced in the future, separate information and, where applicable, additional contractual terms will be provided.

5. Beta Version

Keep2Cook is currently in a beta or testing phase.

The platform is continuously being developed further. Features may be changed, extended, restricted, or discontinued at any time.

During the beta phase, in particular, the following may occur:

6. Account Deletion

You can delete your account at any time using the corresponding feature in Keep2Cook.

When your account is deleted, the content associated with your account is generally deleted.

This includes, in particular:

Technical logs, email logs, and data that are legally required or still needed for technical reasons may be retained for a limited period.

7. Your Own Content

You can store your own recipes and other content in Keep2Cook.

You remain responsible for your content.

You may only upload content whose use is legally permitted for you.

8. Copyright and Third-Party Content

Keep2Cook makes it possible, in particular, to digitize recipes from cookbooks, magazines, recipe cards, or other sources.

The technical ability to upload or process a work does not mean that the required usage rights automatically exist.

You are responsible for ensuring that you use the uploaded content lawfully.

In particular, using Keep2Cook must not infringe copyrights, personality rights, trademarks, or other third-party rights.

9. Recipes from Websites

You can also import recipe content based on a URL.

Keep2Cook may access the specified website and process the recipe information available there.

You may not use this feature to unlawfully collect, reproduce, or redistribute third-party content on a large scale.

You are responsible for observing the terms of use and rights of the respective website.

10. Rights of Use in Content

You retain the rights to your own content, to the extent that these rights are legally yours.

You grant Keep2Cook only the rights required to provide the features you use.

This includes, in particular, storing, processing, displaying, and technically transmitting your content within Keep2Cook and to the technical service providers used.

11. Recipe Visibility

Recipes are visible by default only to connected friends.

You can manually set recipes to private.

Private recipes are visible only to you.

Keep2Cook does not provide a generally accessible public recipe or profile library.

12. Friends Feature

You can search for other users by their @handle and send friend requests.

Personal friend URLs and QR codes can also be used.

A friendship is generally created only after the request has been accepted.

In the settings, automatic acceptance of friend requests can optionally be enabled.

Friendships can be removed at any time.

For the friends feature, only the @handle you have chosen is shown publicly within the platform. Your email address is not shown to other users.

13. Friend Feed

Connected users can see certain activities in the friend feed.

This may include, in particular:

14. Favorite Friends

You can mark individual friends as Favorite Friends.

If this feature has been enabled, the respective person may receive an email as soon as you start cooking a recipe.

The notification may include, in particular, your @handle, the cover image, and a link to the recipe.

This feature must be enabled for individual persons.

15. Shared Shopping Lists

Shopping lists can be shared with other users.

Invited persons can manage the list together, as far as Keep2Cook technically allows.

A shared shopping list remains in place until an authorized person deletes it or ends the sharing.

16. AI Features

Keep2Cook uses Google's Gemini API for various features, including:

Recipe data, images, ingredients, quantities, and other content required for the respective feature may be transmitted to Google.

17. Use of Gemini as a Paid Service

Keep2Cook uses the Gemini API as a Paid Service.

Under the applicable Google terms, prompts, system instructions, files such as images transmitted to Gemini, and the responses generated from them are not used to improve Google products for Paid Services.

Google may log content for a limited period as part of its abuse monitoring. Google currently cites in particular the detection and prevention of violations of its Prohibited Use Policy.

18. Quality of AI Results

AI-generated content may be incorrect or incomplete.

This applies in particular to:

19. Allergies and Health Restrictions

Keep2Cook is not a medical or nutritional advisory platform.

AI-generated or user-created recipes may contain errors or be unsuitable for certain persons.

You are responsible for checking the suitability of a recipe and its ingredients before preparation.

20. Use of the Platform

Keep2Cook may only be used for lawful purposes.

You can send errors, suggestions for improvement, and other feedback to Keep2Cook.

We may use such feedback to fix errors and develop Keep2Cook further.

Screenshots or other files submitted together with a bug report may be deleted once the respective case has been handled.

22. Newsletter

Signing up for the newsletter is voluntary.

Registration uses double opt-in.

You can unsubscribe at any time.

23. Technical Services

Keep2Cook relies on external technical services, in particular:

If these services are unavailable for technical reasons or their interfaces change, individual Keep2Cook features may be temporarily or permanently impaired.

As Keep2Cook is in a beta phase, uninterrupted availability is not guaranteed.

You are responsible for additionally backing up important content.

This applies in particular during the beta phase.

Despite technical and organizational measures, Keep2Cook cannot rule out that data may be lost due to technical errors or outages.

We may suspend or delete user accounts where necessary.

27. Changes to Keep2Cook

Keep2Cook is continuously being developed further.

We reserve the right to change, add, restrict, or discontinue features.

There is no entitlement to the permanent availability of a particular feature.

28. Changes to These Terms of Use

These Terms of Use may be adjusted if the platform, legal requirements, technical conditions, or the features offered change.

We will inform users of material changes in an appropriate manner.

Where legally required, we will obtain explicit consent.

29. Data Protection

The processing of personal data is governed by the current Keep2Cook Privacy Policy, which is available on the platform at any time.

30. Liability

Keep2Cook is liable in accordance with statutory provisions.

For intent and gross negligence, as well as for damages arising from injury to life, body, or health, the statutory liability rules apply.

As far as legally permissible, liability for slightly negligent breaches of duty is limited to the foreseeable and typical damage.

The limitations of liability do not apply where mandatory law provides otherwise.

In particular, no guarantee of freedom from errors or of permanent availability is assumed during the beta phase.

31. Applicable Law

The law of the Federal Republic of Germany applies, unless mandatory statutory provisions prevent this.

32. Place of Jurisdiction

For users acting as consumers, the statutory places of jurisdiction apply.

For merchants, legal entities under public law, or special funds under public law, the operator's registered office is the place of jurisdiction, as far as legally permissible.

33. Final Provisions

Should any provision of these Terms of Use be or become invalid or unenforceable, the remaining provisions shall remain effective.

The statutory provisions shall replace any invalid provision.
